FEATURED JOB POST AGREEMENT
This Featured Job Post Agreement ("Agreement") is entered into between Goldylocks Jobs LLC ("Goldylocks Jobs," "Company," "we," "our," or "us") and the employer purchasing services under this Agreement ("Employer" or "Client").
By purchasing, submitting, or authorizing a featured job posting on Goldylocks Jobs, Employer agrees to be bound by the terms and conditions below.
1. SERVICES
Goldylocks Jobs provides an online employment platform that allows employers to advertise employment opportunities to job seekers.
Under this Agreement, Goldylocks Jobs agrees to publish one or more Featured Job Postings as selected and purchased by Employer.
Featured Job Postings may include enhanced visibility, premium placement, newsletter inclusion, social media promotion, highlighted listings, or other promotional features as described at the time of purchase.
Goldylocks Jobs reserves the right to determine the placement, format, design, and presentation of all featured listings.
2. TERM
This Agreement becomes effective upon Employer's purchase of a Featured Job Posting and remains in effect until the purchased posting period expires or the listing is removed.
Unless otherwise stated, featured postings will remain active for the duration specified at purchase.
3. FEES AND PAYMENT
Employer agrees to pay all applicable fees associated with the selected Featured Job Posting package.
Payment Terms
- Payment is due in full before publication.
- All fees are non-refundable unless otherwise required by law.
- Goldylocks Jobs reserves the right to refuse publication until payment is received.
- Failure to complete payment may result in suspension or cancellation of services.
4. EMPLOYER REPRESENTATIONS AND WARRANTIES
Employer represents and warrants that:
a. Authority
Employer has the authority to enter into this Agreement and submit the job posting.
b. Accuracy
All information provided is accurate, truthful, and current.
c. Legal Compliance
The job posting complies with all applicable federal, state, and local laws, including but not limited to:
- Equal employment opportunity laws
- Anti-discrimination laws
- Wage and hour requirements
- Pay transparency requirements
- Privacy laws
d. Legitimate Opportunity
The position advertised is a legitimate employment opportunity and not a scam, pyramid scheme, multi-level marketing scheme, misleading business opportunity, or fraudulent offering.
e. Intellectual Property
Employer owns or has permission to use all content submitted, including logos, trademarks, text, graphics, and other materials.
5. PROHIBITED CONTENT
Goldylocks Jobs may reject, suspend, edit, or remove any posting that:
- Contains false or misleading information
- Violates applicable laws
- Promotes unlawful activities
- Is discriminatory or harassing
- Contains offensive, defamatory, or obscene material
- Appears fraudulent or deceptive
- Violates intellectual property rights
- Misrepresents compensation, benefits, or job duties
Goldylocks Jobs has sole discretion in determining whether content violates these standards.
6. NO GUARANTEE OF RESULTS
Employer acknowledges and agrees that Goldylocks Jobs does not guarantee:
- Any number of views, clicks, applications, or hires;
- Candidate quality or qualifications;
- Candidate availability;
- Job placement success;
- Return on investment.
Employment outcomes depend on numerous factors outside the control of Goldylocks Jobs.
7. FEATURED STATUS
Goldylocks Jobs reserves the right to determine:
- Placement of featured postings;
- Order of display;
- Search rankings;
- Newsletter placement;
- Promotional scheduling.
Featured status does not guarantee exclusivity or top placement at all times.
8. NEWSLETTER AND PROMOTIONAL DISTRIBUTION
If included in the purchased package, Employer authorizes Goldylocks Jobs to include the job posting in newsletters, email communications, social media promotions, and other marketing channels.
Goldylocks Jobs does not guarantee any minimum audience reach, engagement, applications, or hiring outcomes resulting from such promotions.
9. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDYLOCKS JOBS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT;
- ACCURACY OF INFORMATION;
- UNINTERRUPTED OR ERROR-FREE OPERATION.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDYLOCKS JOBS LLC, ITS OWNERS, OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- INDIRECT DAMAGES;
- INCIDENTAL DAMAGES;
- CONSEQUENTIAL DAMAGES;
- SPECIAL DAMAGES;
- LOST PROFITS;
- LOST REVENUE;
- LOST BUSINESS OPPORTUNITIES;
- LOSS OF DATA;
- REPUTATIONAL HARM;
ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SERVICES PROVIDED.
IN NO EVENT SHALL GOLDYLOCKS JOBS' TOTAL LIABILITY EXCEED THE AMOUNT ACTUALLY PAID BY EMPLOYER FOR THE SPECIFIC FEATURED JOB POSTING GIVING RISE TO THE CLAIM.
11. INDEMNIFICATION
Employer agrees to defend, indemnify, and hold harmless Goldylocks Jobs LLC and its owners, officers, members, employees, contractors, affiliates, successors, and assigns from and against any claims, demands, actions, liabilities, losses, damages, judgments, settlements, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Employer's job posting;
- Employer's hiring practices;
- Violation of applicable laws;
- False or misleading content;
- Intellectual property infringement;
- Breach of this Agreement.
12. INDEPENDENT PLATFORM
Goldylocks Jobs acts solely as an advertising and job distribution platform.
Goldylocks Jobs:
- Is not the employer;
- Does not employ job applicants;
- Does not verify candidate qualifications;
- Does not participate in hiring decisions;
- Is not responsible for employment relationships created through the platform.
All hiring decisions remain solely the responsibility of Employer.
13. TERMINATION
Goldylocks Jobs may suspend, reject, or remove any posting immediately and without refund if:
- Employer breaches this Agreement;
- The posting violates applicable laws;
- Fraudulent activity is suspected;
- The posting creates legal or reputational risk.
14. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
Any legal action arising from this Agreement shall be brought exclusively in the state or federal courts located in California.
15. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties regarding Featured Job Posting services and supersedes all prior discussions, representations, or agreements.
If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
ACCEPTANCE
By purchasing a Featured Job Posting, submitting a job listing, clicking an acceptance checkbox, executing an order form, or otherwise using the services of Goldylocks Jobs LLC, Employer acknowledges that it has read, understood, and agrees to be bound by this Agreement.
